A number of public activities are carried out by the states, regardless of the preferred political system. According to a narrower understanding of the state in some countries, the state operates only in areas such as security and the judiciary, whereas in some states, state activities are observed in areas such as production, logistics and agriculture as a result of a broader understanding of the state. As a result of these activities carried out by the state, there are some legal relations between individuals / legal entities and the state. In addition, activities involving foreigners such as foreign investments in the country in accordance with public policies, determining the status of foreigners who will enter the country, work permits of foreigners are also discussed.

 

Subjecting the administration to a separate law and judicial system from private law is called an administrative regime (régime administratif). Civil Law countries, including Turkey, apply administrative regime. In this regime, the state has certain prerogatives; and disputes arising from the actions and procedures of the state are resolved in the administrative courts. On the other hand, there is no separate law applied to the state in accordance with the regime applied in countries with the Common Law system. Disputes arising from the actions and procedures of the state are heard in the general courts.

 

Administrative law occupies an important place in the country's legal and judicial system. It is necessary to file a lawsuit in the administrative jurisdiction through the case of annulment against the legal proceedings by the state. These transactions can be either an appointment, a disciplinary action or a citizenship or a large foreign investment. Many legal transactions are also carried out by the state in the field of energy. As may be observed, there is a close relationship between a wide range of fields such as energy law, investment law, citizenship law, foreigners law, construction law, public tender law and administrative law.

 

As a rule, it is necessary to open a full court case in the administrative court against the unlawful acts carried out by the state. In full jurisdiction cases, where the claims for material and moral damages are examined, compensation is awarded against the state.
