Mediation is one of the alternative dispute resolution methods. If the dispute between the parties is conducive to mediation, this dispute shall be settled by the process carried out by an expert mediator in the field.

 

Mediation, unlike arbitration, is not a trial and considered under amicable remedies. The text of the agreement reached at the end of the mediation process may be subject to enforcement in a similar manner to the court decisions by taking the executability comment from the relevant court in case of appropriate conditions.

 

Applying to mediation is a cause of action according to numerous legal disputes in Turkey earlier on bring an action before courts. Lawsuits filed without applying to mediation are rejected in procedural terms without examination on the basis of merits. Furthermore, "The United Nations Convention on International Settlement Agreements Resulting from Mediation" , adopted in 2019 and known as the Singapore Convention, was signed by Turkey. Recently, Mediation - Arbitration (Med-Arb) method, in which mediation and arbitration are applied together, has become widespread. In this context, mediation - arbitration rules were published by Istanbul Arbitration Center (ISTAC). The preference of Med-Arb rules, especially in the resolution of commercial disputes, will enable the dispute to be resolved quickly by expert mediators and arbitral tribunals.
